The Platform is accessible via our website https://www.alaviexpress.lk and mobile application AlaviExpress.LK. By continuing to browse, register, or make a purchase through our Platform, you confirm that you understand and accept these Terms, which govern your use of our services and your interactions with the Platform.

Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the website https://www.alaviexpress.lk and the mobile application AlaviExpress.LK (collectively referred to as “the Platform”), which are owned and operated by ZikZen Solutions (Pvt) Ltd. (“we,” “our,” or “us”).

By visiting, registering, or using the Platform in any capacity, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any of the provisions contained herein, you must immediately cease using the Platform.

These Terms constitute a legally binding agreement between you and ZikZen Solutions (Pvt) Ltd. relating to your use of the Platform, including any purchase, account creation, submission of content, or participation in promotions and other related activities.

Eligibility

You must be at least 18 years old to use our Platform. By using AlaviExpress.LK, you represent that you are of legal age to enter into a binding agreement and that all information you provide is accurate and complete. We reserve the right to suspend or terminate any account if false or misleading information is discovered.

User Accounts

To access certain features, including purchasing goods or subscribing to services, you may be required to create an account. When creating an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to promptly notify us of any unauthorized access or breach of your account. We shall not be liable for any loss or damage arising from your failure to protect your credentials. We may, at our sole discretion, refuse registration, suspend, or terminate accounts that violate these Terms or misuse the Platform.

Products, Services, and Purchases

Our Platform enables users to purchase goods, items, or services offered by us and our partners. All purchases made through the Platform are one-time payments unless explicitly stated otherwise.

Prices for products and services are displayed in Sri Lankan Rupees (LKR) and may be subject to taxes or additional fees as required by law. We reserve the right to modify prices or discontinue products at any time without prior notice.

In-app purchases may be available within the AlaviExpress.LK mobile app. These are billed through your chosen app store (Google Play or Apple App Store) and are subject to their respective terms of service.

Subscription Plans

We may offer subscription-based services through the Platform. Subscription terms, pricing, and benefits are detailed at the time of purchase. Unless otherwise specified, subscriptions are not eligible for a free trial period and are billed according to the plan selected by the user.

Failure to pay subscription fees on time may result in suspension or termination of access to the subscribed service. All subscription fees are non-refundable except where required by applicable law.

User-Generated Content

Users may create, upload, post, or share text, images, reviews, or other materials (“User Content”) through the Platform. By submitting content, you grant ZikZen Solutions (Pvt) Ltd. a non-exclusive, worldwide, royalty-free, and irrevocable license to use, reproduce, modify, adapt, display, and distribute such content for operational or promotional purposes.

You agree not to post any material that is defamatory, obscene, illegal, or infringes upon any intellectual property rights. We reserve the right to remove any content deemed inappropriate or violating these Terms.

If you believe that any content on the Platform infringes your intellectual property rights, please notify us immediately at Info@AlaviExpress.LK.

Ownership and Intellectual Property

All content, features, designs, logos, trademarks, and materials available on the Platform—including but not limited to text, graphics, layouts, icons, images, software, and source code—are the exclusive property of ZikZen Solutions (Pvt) Ltd. and are protected under applicable copyright, trademark, and intellectual property laws of Sri Lanka.

Users are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes. You may not copy, modify, distribute, or use any part of the Platform for commercial gain without our prior written consent.

Any unauthorized use or reproduction of our intellectual property may result in legal action.

Feedback and Suggestions

We value feedback, comments, and suggestions from users. By submitting feedback to us, you acknowledge and agree that we may use, implement, or modify our services based on your suggestions without compensation, credit, or obligation.

You waive any rights to ownership or royalties arising from such feedback.

Promotions, Contests, and Sweepstakes

From time to time, AlaviExpress.LK may offer promotions, discounts, contests, or sweepstakes to users. These activities are governed by specific rules or terms that may vary from these general Terms. Participation in any promotional activity constitutes acceptance of those specific terms in addition to this Agreement.

Payment and Billing

When purchasing through our Platform, you may pay via Cash on Delivery, Bank Transfer, or through secure online payments using PayHere. All payments must be made in Sri Lankan Rupees (LKR).

For digital or subscription-based purchases made through the app, payments will be processed through the applicable app store’s billing system. You are responsible for ensuring sufficient funds and accurate billing information.

We reserve the right to cancel or refuse any order if fraud, unauthorized activity, or violation of these Terms is suspected.

Limitation of Liability

To the maximum extent permitted by law, ZikZen Solutions (Pvt) Ltd., its affiliates, directors, employees, and agents shall not be held liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Platform, products, or services.

While we strive to ensure accurate pricing, product descriptions, and availability, we do not guarantee that all information on the Platform is error-free. In the event of an error, we reserve the right to correct it and revise affected transactions.

Indemnification

You agree to indemnify, defend, and hold harmless ZikZen Solutions (Pvt) Ltd., its directors, employees, partners, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your breach of these Terms or misuse of the Platform.

Termination

We may, at our sole discretion, suspend or terminate your access to the Platform at any time without prior notice if we believe you have violated these Terms, engaged in fraudulent activity, or harmed other users. Upon termination, your right to use the Platform ceases immediately, but obligations arising prior to termination shall survive.

Third-Party Links and Services

The Platform may contain links to third-party websites, services, or advertisements that are not owned or controlled by us. We are not responsible for the content, terms, or privacy policies of such third parties. Accessing them is at your own risk.

Disclaimer of Warranties

The Platform and all content, services, and products are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or harmful components.

Governing Law and Jurisdiction
